(Dan Tri) - Decree No. 330/2026/ND-CP issued on August 19 of the Government has detailed regulations on sanctions for administrative violations in the field of cybersecurity and personal data protection.

Article 14 specifically regulates acts of using cyberspace, information technology, and electronic means to violate economic management order but not to the extent of criminal prosecution.

According to Clause 1 of Article 14, a fine of 5-10 million VND will be applied to the act of selling, renting, lending, or giving away one's own digital account information.

Types of regulated digital accounts include bank accounts, bank cards, e-wallet accounts, mobile money accounts, securities accounts, insurance accounts, tax accounts and any other digital accounts with financial transaction functions.

In the higher penalty bracket in Clause 2, a fine of 10-20 million VND will be applied to violations related to identity and illegal financial transactions. Specifically, this penalty targets the act of using fake identities, fake documents or illegally using other people's information to register, set up financial transaction accounts or establish businesses.

At the same time, acts of using digital accounts as intermediary payment tools without a license; rent or lease services to receive messages and calls to authenticate digital accounts; and using digital accounts to illegally buy, sell or exchange foreign currency are also penalized in this framework.

Clause 3 of Article 14 raises the fine to 20-30 million VND for the act of setting up electronic information pages, digital accounts or performing electronic transactions that cause confusion about the information provider of agencies, organizations and individuals.

This penalty framework also applies to acts of providing and sharing digital content that violates copyright and intellectual property online; Using login information and digital account access rights against regulations; establishing and operating exchanges or digital platforms that do not meet legal requirements; or advertising and trading of goods that do not comply with regulations on origin, origin, or quality but do not reach a criminal level.

The highest fine range in Article 14 ranges from 70-100 million VND. This measure applies to the act of opening a digital account without proper order and procedures or maintaining a financial transaction account with fake identification information or bogus information in the national population database or database of organizations and businesses.

The act of opening digital accounts for subjects on the list of people banned from opening and using digital accounts is also subject to the same penalty.

For violations in Clause 1 related to buying, selling, leasing, lending, or donating bank accounts or e-wallets, the authorities will confiscate exhibits, vehicles, and money in the violating account.
