Proposal to decentralize authority to promulgate technology import policy

On the afternoon of August 17, the National Assembly Standing Committee commented on the draft law amending and supplementing a number of articles of the Law on Radio Frequency, the Law on Telecommunications, the Law on Electronic Transactions and the Law on Technology Transfer. The bill is expected to be passed by the National Assembly on August 24.

Minister of Science and Technology Vu Hai Quan said the bill focuses on simplifying administrative procedures and business conditions; Promote decentralization, decentralization and complete the legal corridor for telecommunications infrastructure development.

With the Law on Technology Transfer, the draft transfers some authority from the Prime Minister to the Ministry of Science and Technology to increase initiative for specialized management agencies and shorten the time to develop and promulgate policies.

Specifically, the Ministry of Science and Technology is assigned to preside over and coordinate with ministries, provincial-level People's Committees and relevant agencies to develop programs, projects and policies on technology import, science and technology market development, and promotion of technology transfer, application and innovation.

The Ministry is entitled to promulgate programs, projects and policies within its authority; In case of exceeding authority, it must be submitted to the competent authority for consideration and decision. The Ministry also presides over the development and promulgation of the national science and technology market development program.

According to the Government, this regulation is consistent with the Law on Government Organization and the Law on Science, Technology and Innovation, and does not eliminate the mechanism for submitting to competent authorities for major, interdisciplinary issues.

National programs must still be evaluated by a council consisting of representatives of ministries, branches, localities and experts. Appraisal content includes necessity, goals, expected results, feasibility, commercialization ability and socio-economic impact.

The addition of the Provincial People's Committee to the group of coordinating agencies aims to help policies align with local reality, clearly identify resources and make implementation more convenient.

In response to the proposal to shift the focus from importing to receiving and mastering technology, especially in the health sector, the Government believes that current laws already regulate knowledge transfer, professional processes, training, technical support, operation and maintenance.

The contents of valuation, core technology support and effective use of budget have been stipulated in current law or will continue to be studied when comprehensively amending the Law on Technology Transfer.

Regarding mobile infrastructure, the draft supplements regulations to develop and effectively use passive telecommunications technical infrastructure to meet the needs of deploying high-bandwidth networks.

Enterprises must make 5-year and annual passive infrastructure development plans, and provide data for management agencies to monitor and orient the network. The Government will continue to improve regulations to facilitate investment, increase shared capabilities and optimize infrastructure.

The bill also proposes to abolish, simplify or amend 54 business conditions and abolish two administrative procedures. The government said each content has been evaluated in terms of management objectives, risks to be controlled and alternative tools.

The agency responsible for post-inspection, inspection methods, data for management and measures to handle violations are also identified to avoid creating legal gaps after cutting down procedures.

The Committee for Science, Technology and Environment endorsed the draft's major policy groups, including the transfer of some authority from the Prime Minister to the Ministry of Science and Technology.

The inspection agency requests that the Government and the Ministry of Science and Technology soon issue guiding documents, ensuring that they take effect at the same time as the law; Arrange resources for post-audit, especially on radio frequency, national domain name ".vn" and digital signature authentication service.
